Welcome to FormVeritas. FormVeritas is a product of One Big Media Company LLC.

Eligibility: By using the site, applications, and Services, you represent and warrant that you are at least 18 years of age and are legally able to enter into a binding contract.

Minors and Children's Data: The Services are strictly restricted to users who are 18 years of age or older. The Services are not directed to children under 13, and we do not knowingly collect personal information online directly from children under 13. If we become aware that a minor has created an account or submitted their own data directly to us, we may delete it without notice. However, we acknowledge that adult users and Agency Users may upload immigration forms containing the personally identifiable information of minor children or dependents. By uploading such documents, you represent and warrant that you are the parent, legal guardian, or authorized legal representative with the lawful right and authority to consent to the processing of the minor's data through our Services.

These Terms of Service ("Terms") constitute a legally binding agreement between you (whether personally or on behalf of an entity) and One Big Media Company LLC concerning your access to and use of the FormVeritas website, applications, APIs, and services (collectively, the "Services"). By accessing, registering for, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Privacy Policy: Our Privacy Policy is expressly incorporated into these Terms by reference.

Electronic Signature Consent: By selecting "I Agree," "Start Audit," creating an account, or continuing to use the Services, you agree that your electronic acceptance is the legal equivalent of your manual signature on this Agreement.

1. Disclaimer: Not Legal Advice (No Attorney-Client Relationship)

FormVeritas is an automated software tool. We are not a law firm, we are not attorneys, and we do not provide legal advice.

Use of our Services does not create an attorney-client relationship between you and One Big Media Company LLC. We do not review your answers for legal sufficiency, draw legal conclusions, provide legal opinions, or make recommendations about your immigration options. The Services and Audit Reports are provided for informational and self-help purposes only. You are solely responsible for the final review, accuracy, and legal compliance of any petition submitted to USCIS or any other government agency.

Statutory Exemption: FormVeritas provides self-help software functionality only. We do not act as your Legal Document Assistant (LDA), paralegal, or Immigration Consultant under California Business and Professions Code or any similar state statutes. You represent yourself in all legal matters and are solely responsible for your own filings.

No Government Affiliation: FormVeritas is an independent, private software company. We are not affiliated with, endorsed by, approved by, or connected to the United States Citizenship and Immigration Services (USCIS), the Department of Homeland Security (DHS), or any other local, state, or federal government agency.

2. Description of Service, Licenses, & Operational Limitations

Service Access License: Subject to your compliance with these Terms, One Big Media Company LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purposes. This license may be revoked at any time if you violate these Terms.

One Big Media Company LLC provides an automated, rules-based software tool designed to review user-provided data and check for common formatting errors, omissions, and logic conflicts in immigration forms based on public USCIS instructions. We do not guarantee that using our Services will result in a successful visa application, prevent Requests for Evidence (RFEs), or that the software will catch every possible error. FormVeritas does not guarantee any immigration outcome, approval, visa issuance, or government decision.

Data Input Accuracy: The accuracy of the FormVeritas deterministic logic engine relies entirely on the quality, legibility, and completeness of the documents you upload. We are not responsible or liable for any missed flags, false positives, or erroneous audit results caused by blurry, corrupted, poorly scanned, incomplete, or illegibly handwritten documents.

No Document Storage or Backup: FormVeritas does not provide document storage or backup services. Users are solely responsible for maintaining independent copies of all their documents and records.

Currency of Legal Information: FormVeritas strives to keep its auditing logic and form dependencies accurate and up-to-date. However, because immigration law, USCIS guidelines, and form editions change rapidly, FormVeritas cannot guarantee that all logic matrices are completely current at the exact moment of your audit. The legal information and logic contained in the Services is not guaranteed to be correct, complete, or up-to-date.

Jurisdictional Limitations: The Services are designed specifically for U.S. immigration forms and instructions and may not be suitable for use in other jurisdictions.

Accessibility: FormVeritas strives to meet WCAG accessibility standards but does not guarantee compatibility with all assistive technologies.

Service Modifications: We reserve the right to modify, suspend, or discontinue any part of the Services at any time, including features, functionality, APIs, or modules, with or without notice.

No Service Level Guarantees (SLA): Unless expressly stated in a separate written agreement, FormVeritas does not guarantee uptime, availability, or service performance levels.

Service Disruptions and Deadlines: FormVeritas does not guarantee that the Services will be available at any particular time or location, or that they will function without delay or interruption. You acknowledge that service disruptions, scheduled downtime, or internet outages may occur. Because immigration filings are subject to strict government deadlines, you are solely responsible for ensuring you leave adequate time to complete your work. One Big Media Company LLC shall not be liable for any missed filing deadlines, expired visas, or agency rejections resulting from platform downtime or service delays.

Beta Services: From time to time, we may offer features, form modules, or pre-orders labeled as "Beta," "In Training," or "Early Access." Such features are provided strictly "AS-IS" and may contain bugs, errors, or inaccuracies. We make no warranties regarding the performance of Beta Services.

3. Automated Outputs and Data Processing

FormVeritas utilizes deterministic logic matrices and proprietary algorithms exclusively for the purpose of auditing, validating, and extracting data from uploaded documents.

  • Mandatory Human Review & Informational Use: FormVeritas utilizes advanced logic matrices to generate Audit Reports. However, you acknowledge that automated document parsing technologies can be imperfect. Outputs may occasionally be inaccurate, incomplete, or fail to capture complex legal nuances. Audit reports are provided for informational purposes only and cannot be relied upon as a compliance guarantee. The Services are designed to assist professionals, not replace them. You represent and warrant that you will subject all Audit Reports to independent human review and evaluate their accuracy before relying on them for any legal filing or official purpose.
  • Transient Processing & Data Isolation: Your data is processed transiently in memory to evaluate form logic and generate your audit report. We do not use your personal information, client data, or uploaded documents to train internal algorithms or build alternative profiles. Data is strictly isolated during processing.
  • Local & Deterministic Processing: Document data extraction and analysis are performed securely. We do not transmit your sensitive documents to external, third-party cloud extraction models. Furthermore, your data is never used to train, improve, or fine-tune any automated or machine-learning models.

4. Data Privacy, Security, and Zero-Retention

Zero-retention processing of uploaded immigration documents

FormVeritas operates using a privacy-first zero-retention architecture. Source documents uploaded for audit are processed in a transient, isolated processing environment. Once the audit process is completed and the report is generated, the uploaded source documents are automatically destroyed and are not persistently retained by FormVeritas.

For clarity, this zero-retention commitment applies to uploaded source documents. It does not necessarily apply to derived report outputs, account information, billing records, support records, security logs, or operational metadata, which may be retained in accordance with our Privacy Policy and internal retention practices. Generated audit reports may be stored within the user account environment for operational purposes subject to account settings, user deletion, internal retention practices, and applicable law.

Limited Technical Artifacts: FormVeritas does not maintain persistent storage of uploaded source immigration documents following completion of audit processing, except for limited transient technical artifacts. System logs, security telemetry, error traces, or transient processing buffers may temporarily capture metadata or partial processing data strictly for the purpose of system security, troubleshooting, abuse prevention, or operational stability. These artifacts are retained only for the limited period reasonably necessary for security, troubleshooting, abuse prevention, legal compliance, or operational stability, and are then deleted or overwritten in accordance with internal retention practices.

No Document Storage or Backup (Data Loss): FormVeritas does not provide document storage or backup services. Users are solely responsible for maintaining independent copies of all their documents and records. Because FormVeritas does not retain uploaded documents, the company shall not be responsible for any loss, deletion, corruption, or inability to retrieve user data.

Platform Abuse Monitoring: While we utilize zero-retention for source documents, we reserve the right to monitor usage patterns, system logs, and metadata necessary to maintain platform security, detect fraud, enforce rate limits, and investigate abuse.

Data Ownership: You retain all ownership rights to the documents and data you upload. One Big Media Company LLC claims no ownership over your personal data or your clients' data. However, the format, risk-scoring methodology, and layout of the resulting Audit Report remain the proprietary intellectual property of One Big Media Company LLC.

International Data Transfer and Residency: FormVeritas servers and data centers are located in the United States. By accessing the Services from outside the United States, or by uploading the data of foreign nationals, you expressly consent to the transfer, processing, and storage of such data in the United States. You are solely responsible for ensuring that your use of the Services complies with your local data sovereignty, data localization, and privacy laws.

Data Subject Rights (EEA, UK, and Similar Jurisdictions): If you are located in the European Economic Area (EEA), United Kingdom, or other jurisdictions with similar data protection laws, you may have certain rights regarding your personal data, including the right to request access, correction, deletion, restriction of processing, or portability of your personal data. Requests may be submitted to [email protected]. You acknowledge that because FormVeritas uses transient processing and zero-retention architecture, many requests such as deletion may already be technically satisfied by the system design.

Permanent Data Deletion and Account Closure: Users may request permanent deletion through the permanent-delete control in account settings where enabled, or by emailing [email protected]. We aim to complete verified deletion requests within 30 days. Backup, log, billing, tax, anti-fraud, dispute, or legally retained records may take up to 90 days to age out or may be retained in redacted form where required by law or legitimate security, billing, tax, anti-fraud, or dispute obligations.

USCIS Case Tracker and FOIA Tool Data: If you use the USCIS Case Tracker or FOIA Request Tool, you authorize FormVeritas to process the receipt numbers, FOIA request details, family or representative information, supporting files, status history, and USCIS response data needed to submit requests to USCIS, retrieve status updates, and display those updates in your account. Submitting FOIA records may affect other people named in family, guardianship, dependent, deceased-subject, or related-history records, so you are responsible for having the legal authority and consent required to provide that information.

User Data Incidents: If you suspect or become aware of any unauthorized access to your account, or that a user’s credentials have been stolen, lost, or compromised, you must notify FormVeritas within twenty-four (24) hours by emailing [email protected]. You agree to cooperate fully with our security team to investigate and remediate any such data incidents.

Security Limitations: While we implement enterprise-grade security measures and auto-deletion protocols to protect your data, no method of transmission over the Internet or electronic storage is 100% secure. You acknowledge that you upload sensitive data at your own risk.

5. Account Registration, Security, and Termination

Account Security and Password Sharing: You must assign a unique username and password to each authorized user. User credentials may not be shared with or used by any other person. You are solely responsible for all activity occurring under your account and for maintaining the confidentiality of your credentials.

User Device Security: You are responsible for securing the devices, networks, and systems used to access the Services, including maintaining updated operating systems, malware protection, and secure network connections.

Account Disputes: We do not arbitrate or resolve internal management or ownership disputes regarding Agency accounts. If we become aware of a dispute regarding account ownership, we reserve the right, in our sole discretion, to suspend access to the account and all related data until the disputing parties provide written documentation (such as a court order or settlement agreement) proving the dispute has been resolved.

Account Suspension and Termination: We may suspend, restrict, or terminate accounts at any time, with or without notice, except where notice is required by applicable law, for Terms violations, suspected fraud, non-payment, or if we reasonably believe continued access could expose the company to legal liability, regulatory violation, or security threats. Upon suspension or termination, your right to access or use the Services immediately ceases, and we may disable access to associated reports, configurations, and account features.

6. Acceptable Use Policy (User Conduct)

You agree to use the Services only in compliance with all applicable laws and regulations. Specifically, you agree NOT to:

  • Upload documents containing malicious code, viruses, or malware.
  • Attempt to bypass, exploit, or circumvent our billing, quota limits, or rate-limiting systems.
  • Engage in unauthorized automated access, including API scraping, reverse engineering, bulk data extraction, or dataset harvesting.
  • Share your account credentials with unauthorized users. Each user/agent must have their own authorized login.
  • Use the Service to commit, facilitate, or encourage immigration fraud, identity theft, or the submission of falsified documents to the U.S. Government.

Monitoring and Enforcement: We reserve the right to monitor usage of the Services for the purpose of ensuring compliance with these Terms and protecting platform integrity. We reserve the right to enforce rate limits, automate blocking, throttle traffic, or issue IP bans to prevent abuse, protect platform stability, and ensure fair use of the Services.

Anti-Fraud Provision: We reserve the right to investigate accounts suspected of fraud, document falsification, identity theft, or immigration abuse, and we may cooperate with law enforcement in such investigations.

Responsible Security Research: Good faith security testing must not involve exploitation, service disruption, unauthorized access to user data, or attempts to extract system logic. All vulnerabilities must be reported through our responsible disclosure process, and adherence to these guidelines will not result in legal action or account termination.

Right to Refuse Service: One Big Media Company LLC reserves the right to refuse service to anyone, cancel orders, or terminate user access at any time, for any reason, in its sole and absolute discretion without notice or refund, except where required by applicable law, if we determine you have violated this Acceptable Use Policy.

7. Third-Party Services and Links

The Services may contain links to third-party websites, including USCIS or other government sites, and may integrate with third-party software, infrastructure, and service providers. These include USCIS and DHS systems for case status and FOIA workflows, Supabase for authentication, database, storage, and edge-function infrastructure, Stripe for billing, Pushbullet for limited internal operational alerts where enabled, and email, SMS, hosting, monitoring, security, or support providers needed to operate the Services.

We do not sell your personal information, client data, uploaded documents, USCIS case tracker data, FOIA request data, or mobile opt-in data for profit or other monetary consideration. Service providers and subprocessors are bound to use data only for the services they provide to us, and they may not use or disclose user information, including de-identified, anonymized, or pseudonymized data, for their own purposes without active user consent or a legal requirement.

We do not control, endorse, or assume responsibility for third-party websites that you choose to visit outside the FormVeritas Service. Government systems, including USCIS and DHS systems, may maintain their own records and legal obligations once you submit information to them.

8. Agency, B2B, and White-Label Provisions

If you are using the Service on behalf of a law firm, agency, or as a third-party preparer ("Agency User"), the following additional terms apply:

  • Data Controller/Processor Relationship: For the purposes of applicable data protection laws (including GDPR), Agency Users act as the "Data Controller" for their clients' data, and FormVeritas acts solely as a "Data Processor". To the extent required by applicable law for the transfer or processing of EU/UK personal data, enterprise and Agency Users may request to enter into a separate Data Processing Agreement (DPA) incorporating Standard Contractual Clauses (SCCs). FormVeritas will perform processor obligations required by applicable law to the extent such obligations apply to the Services, but the Agency User remains solely responsible for determining the lawful basis for processing, issuing required notices, obtaining consents where required, and responding to data subject requests except to the extent applicable law requires our assistance as processor.
  • Subprocessors: We may use subprocessors and service providers in connection with the Services, subject to applicable law, appropriate contractual safeguards, and our Privacy Policy or any applicable data processing agreement.
  • Client Consent Warranty: You explicitly represent and warrant that you have obtained all necessary, legally compliant consents from your clients to upload their Personally Identifiable Information (PII) and sensitive documents into the FormVeritas system for automated processing.
  • Pass-Through Disclaimer: When utilizing the White-Label features to provide Audit Reports to your clients, you agree to inform your clients that the automated audit does not constitute legal advice.
  • Accountability: You are fully responsible for all activity occurring under your Agency account, including the actions of invited Team Members ("Agents").

No Third-Party Beneficiaries: This Agreement is strictly between you and One Big Media Company LLC. There are no intended third-party beneficiaries to these Terms. If you are an Agency User, your clients have no direct contractual relationship with us and no legal standing to enforce these Terms or seek damages against us for any reason.

9. Export Controls and Sanctions

The Services are subject to U.S. export controls and economic sanctions laws. You represent and warrant that you are not located in, under the control of, or a national or resident of any embargoed country (including, but not limited to, Cuba, Iran, North Korea, Syria, or the Crimea region) and that you are not listed on any U.S. Government list of prohibited or restricted parties (such as the Treasury Department's list of Specially Designated Nationals).

10. Government and Law Enforcement Requests

We may disclose your information, including your data and client records, to courts, law enforcement, or governmental authorities if we are required to do so by law, subpoena, or court order. Unless legally prohibited from doing so, we will use commercially reasonable efforts to notify you of such a request so that you may seek a protective order. You agree that FormVeritas has no obligation to challenge or defend against any such legal process on your behalf.

11. A2P SMS & Communication

By providing your phone number and opting in, you consent to receive text messages (SMS) from One Big Media Company LLC related to your account, audit status, billing, and support. Consent to receive SMS messages is not a condition of purchasing any services. You may opt-out at any time by replying STOP. Message and data rates may apply. Mobile information and consent data will not be shared with, sold to, or distributed to any third parties for marketing purposes.

12. Affiliate Program

We use affiliates to promote our Services. If you create an account or make a purchase after clicking a tracking link, a referring third-party affiliate may earn a commission from us at no additional cost to you. Participation in our Affiliate Program is subject to approval, compliance with FTC disclosure guidelines, and may be terminated at our sole discretion for spam or fraudulent activity.

13. Payment, Taxes, and Purchases

One Big Media Company LLC will charge your chosen payment method for any paid transactions. Paid account access, Audit Packs, eligible add-ons, and pre-ordered modules are charged as one-time purchases unless a separate written agreement states otherwise.

Taxes and Collections: You are responsible for all sales, use, value-added, or similar taxes imposed by any governmental authority arising from your use of the Services. If you fail to pay Service Fees on time, or if a chargeback is initiated, we reserve the right to immediately suspend your account. For accounts in default, we may charge interest on delinquent amounts at the lesser of 1.5% per month or the maximum rate permitted by law. If we must engage an attorney or collections agency to recover amounts owed by you, you agree to be liable for all costs associated with such collection efforts, including reasonable attorneys' fees and collection agency fees.

Modifications to Pricing: We reserve the right to adjust pricing for our Services or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Any price changes will take effect following notice to you (e.g., via email or dashboard notification).

Government Entities and Sovereign Immunity: If you are a government entity, you represent that the person accepting these Terms has authority to bind the entity to the extent permitted by applicable law.

Final Sale Policy

FormVeritas purchases are final. Paid account access, Audit Packs, add-ons, pre-orders, and other digital purchases are not refundable except where a refund is required by applicable law.

Audit capacity is account-scoped, does not expire, and is not tied to recurring billing. If you believe a charge is incorrect or unauthorized, email [email protected] so we can review the billing record before any card dispute is initiated.

14. Intellectual Property and Trade Secrets

All content, features, and functionality of the Services—including the FormVeritas engine, deterministic logic matrices, algorithms, data schemas, validation logic, rule matrices, scoring engines, user interfaces, text, graphics, logos, and software—are the exclusive property and proprietary trade secrets of One Big Media Company LLC and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.

Limited Permission to Use and Resale Prohibition: FormVeritas grants you a limited, personal, non-exclusive, non-transferable license to use our audit reports for your own personal use, or if you are an authorized Agency User, for your internal business use with your client. Unless explicitly permitted under a FormVeritas Agency White-Label agreement, you acknowledge and agree that you may not sell, redistribute, modify, or exploit the generated audit reports for commercial gain without the express written consent of One Big Media Company LLC.

RESTRICTIONS (You shall not):

  • Reverse engineer, decompile, disassemble, or attempt to discover the source code, data schemas, or logic matrices of the Service.
  • Modify, copy, or create derivative works based on the Service.
  • Use the Service to build a competitive product.
  • Use the Service, its outputs, or its audit reports to train, calibrate, or build any artificial intelligence models, machine learning models, or automated document auditing software.

Open Source Attributions

The Services utilize certain unmodified open-source software components, including the MinerU extraction engine, licensed under the GNU Affero General Public License v3.0 (AGPL-3.0). This component operates as a standalone, isolated service that communicates with our platform exclusively through a private Application Programming Interface (API).

FormVeritas is an independent work; our proprietary logic, rule matrices, and audit engines are not derivative works of this open-source component and remain entirely closed-source. The source code for the unmodified MinerU component is publicly available at https://github.com/opendatalab/MinerU.

15. Copyright Infringement (DMCA Notice)

If you believe that any content or document uploaded through the Services infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA). DMCA notices must include the information required by 17 U.S.C. § 512(c)(3) and be sent to our designated Copyright Agent at [email protected] and the mailing address listed in Section 22. FormVeritas will comply with the safe harbor provisions of 17 U.S.C. § 512 and reserves the right to terminate access for repeat infringers.

16. Unsolicited Submissions and Feedback

Except as required for your use of the Services, One Big Media Company LLC does not want you to submit confidential or proprietary ideas to us. All comments, feedback, feature requests, or material submitted to FormVeritas shall be considered non-confidential and the sole property of One Big Media Company LLC. By providing such submissions, you irrevocably assign to us, at no charge, all worldwide right, title, and interest in and to the submissions. We shall be free to use, build, and disseminate such submissions on an unrestricted basis without compensation to you.

17. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, One Big Media Company LLC expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise.

We specifically disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses, and we do not guarantee the accuracy or reliability of any outputs or audit reports generated by the Service.

18. Indemnification

You agree to defend, indemnify, and hold harmless One Big Media Company LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service, your use of the Services, or any claim from a third party (including your clients) arising from your use of the Services to process their data.

Subpoenas and Legal Process: If we are required to respond to a subpoena, court order, or other compulsory legal process initiated by a third party or government agency relating to your account, your data, or your clients, you agree to reimburse us for our reasonable costs, engineering time, and attorneys' fees incurred in responding to such process.

19. Limitation of Liability

To the fullest extent provided by law, One Big Media Company LLC, its affiliates, licensors, service providers, employees, agents, officers, and directors will not be liable for damages of any kind, under any legal theory, arising out of or in connection with your use of, or inability to use, the Services. This includes direct, indirect, special, incidental, consequential, or punitive damages, loss of revenue, loss of profits, loss of business, loss of data, or damages resulting from delays, denials, or Requests for Evidence (RFEs) issued by USCIS or any government agency.

Breach Liability Exemption: In the event of a third-party cyberattack, data breach, or unauthorized access despite our commercially reasonable security safeguards, FormVeritas shall not be liable for any direct, indirect, or consequential damages arising from such events.

Liability cap: the total cumulative liability of One Big Media Company LLC for all claims arising out of or relating to these Terms or the Services will not exceed the greater of the amount you paid to us in the twelve (12) months preceding the claim or one hundred U.S. dollars ($100.00).

Waiver of Injunctive Relief: You agree that your sole remedy for any breach of this Agreement by us shall be an action at law for damages. You shall not be entitled to seek equitable or injunctive relief to enjoin or restrain the operation of the Services.

California Residents Waiver: If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

Force Majeure: We shall not be held liable for any delay or failure in performance arising out of acts of God, war, terrorism, strikes, third-party hosting outages (e.g., AWS, Supabase, Stripe), or other circumstances beyond our reasonable control.

20. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY—IT AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution: Before initiating any arbitration, you and One Big Media Company LLC agree to first attempt to resolve the dispute informally for at least thirty (30) days. You must send a written notice describing the claim and relief sought to [email protected].

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Delaware before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. For claims under $10,000, you may choose whether the arbitration proceeds in person, by telephone or virtual conference, or based solely on written submissions.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, (i) no arbitration or proceeding shall be joined with any other; (ii) there is no right or authority for any dispute to be arbitrated or resolved on a class action-basis or to utilize class action procedures; and (iii) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons. Arbitration will occur individually and will not be consolidated with any other proceeding.

Time Limit on Claims: YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Right to Opt-Out: You have the right to opt out of binding arbitration within 30 days of the date you first created your account by sending an email to [email protected] indicating your clear intent to opt out. If you opt out, any disputes will be resolved in the state or federal courts located in the State of Delaware.

Mandatory Consumer Protections: If you reside in a jurisdiction where mandatory consumer protection laws apply (such as the EU or UK), those laws may provide additional rights that cannot be waived by contract, and the arbitration requirements or venue selections herein may not apply to you.

21. General Provisions

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

Survival: All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity obligations, dispute resolution, and limitations of liability.

Entire Agreement: These Terms and our Privacy Policy constitute the sole and entire agreement between you and One Big Media Company LLC regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

Modifications to Terms: We reserve the right to modify or replace these Terms from time to time. If a revision is material, we will provide notice and a plain-language summary before the updated terms apply to affected authenticated features.

Active Consent for Material Policy Changes: When we make material changes to these Terms or the Privacy Policy, we will provide a plain-language summary of the changes and require active consent before you continue using affected authenticated features. Active consent may be collected through an in-app checkbox, account modal, electronic signature, or another clear affirmative action. Prior acceptance of an older version is not treated as consent to a materially updated version.

Assignment and Ownership Transfers: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, bankruptcy, or similar transfer. If such a transfer affects user data, we will notify users when practical. Any successor must either honor privacy protections that are materially consistent with our Privacy Policy and these Terms, or provide users a reasonable option, where technically feasible, to securely delete, export, download, transmit, or dispose of their information before a materially different policy applies.

Business Closure: If we end the Service, we will provide reasonable notice when practical and give users instructions for deleting or exporting available account data before shutdown, subject to security, legal, billing, tax, dispute, and anti-fraud obligations.

No Waiver: No waiver by One Big Media Company LLC of any term or condition shall be deemed a further or continuing waiver of such term or any other term.

Language: Certain materials on the FormVeritas site, including audit reports and these Terms, may be translated into other languages for convenience. In the event of any ambiguity or conflict between translations, the English version is authoritative and legally controls.

Governing Law: These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
